FILMPAC PRIVACY POLICY

This FILMPACTM PRIVACY POLICY (“Policy”) describes how FILMPAC LLC, an Oregon limited liability company (“FILMPAC”) collects and uses the personal information you provide on www.filmpac.com and it’s subdomains (“Site”), and through email and other direct correspondence. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

We will only process your personal information in accordance with applicable data protection and privacy laws. For the purpose of UK and European Union data protection legislation, the data controller is FILMPAC LLC which is located at 415 Lincoln Street, Eugene, OR 97401 and can also be contacted by emailing info@filmpac.com.

SECTION 1. COLLECTION OF PERSONAL INFORMATION.

We collect information about you in a range of forms, including personal information. We collect the following personal information from you:

1.1 Information You Provide. We may collect personal information, such as your name, phone number, location, payment information, employment information (e.g., resume) and email address when you register for our Service, sign up for our mailing list, apply for a job with FILMPAC, or otherwise communicate with us. We may also collect any communications between you and FILMPAC and any other information you provide to FILMPAC, including Account based features like My Favorites, My Projects, and Purchase History.

1.2 Information Obtained from Third Parties. We may receive personal information about you from third parties and combine that with information we collect through our Service. For example, we may obtain information when you log in through a third-party social network or authentication service, such as LinkedIn, if you apply for a job with us. These services will authenticate your identity and provide you the option to share certain personal information with us, which could include your name, email address, work experience, or other information. The information we receive from these third-party sites is dependent upon that third party’s policies and your privacy settings on that third-party site. You should always review and, if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our website or Service. We may obtain information from other sources, such as third-party information providers, or through mergers and acquisitions, and combine this with information previously collected. In these cases, our Privacy Policy governs the handling of the combined personal information.

1.3 Information Automatically Collected. As is true of most websites, we automatically gather information about your computer such as your IP address, browser type, referring/exit pages, and operating system. For further information about Cookies and other Tracking Technologies, see Section 4.

We do not sell your personal information to third parties, and will only share your personal information with third parties in the ways that are described in this Policy:

3.1 Third Party Service Providers.

  1. We may provide your personal information to companies that provide services to help us with our business activities such as offering customer service. These companies are authorized to use your personal information only as necessary to provide these services to us.

3.2 Other Disclosures. We may also disclose your personal information:

  1. as required by law such as to comply with a subpoena, or similar legal process, including to respond to requests from public and government authorities to meet national security or law enforcement requirement;
  2. when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  3. if FILMPAC is involved in a merger, acquisition, or sale of all or a portion of its assets.

3.3 Third Party Advertisers. We may share your personal information with other companies so that they can market their products or services to you. If you do not want us to share your personal information with these companies, contact us at info@filmpac.com.

SECTION 4. COOKIES AND OTHER TRACKING TECHNOLOGIES

We and our partners may use cookies and other electronic tracking technologies to keep track of your visits, preferences and profile information. A cookie is a small, unique text file that a website can send to your computer when you visit a site. We may use session cookies, which terminate when a user closes his or her browser, and/or persistent cookies, which remain on the user’s computer until manually deleted. Our Site may contain links to third party websites and features. This privacy statement does not cover the privacy practices of such third parties. These third parties have their own privacy policies and we do not accept any responsibility or liability for their websites, features or policies. Please read their privacy policies before you submit any data to them.

SECTION 7. SECURITY

The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

SECTION 8. RETENTION.

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to fulfill business needs and to comply with our legal obligations, resolve disputes, and enforce our agreements.

SECTION 9. CHILDREN.

Our Site is not directed to children under 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us using the details in the Contact Information section below. We will delete such information from our files as soon as reasonably practicable.

SECTION 10. SENSITIVE PERSONAL INFORMATION

Subject to the following paragraph, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through Site or otherwise to us.

  2. automated decision making and/or profiling;
  3. any new processing of your personal information we carry out beyond
    the original purpose(s); or
  4. the transfer of your personal information outside the European Economic Area.
  5. Please note that your use of some of the Site may be ineffective upon optout.

11.2 Access. You may access the information we hold about you at any time via your profile or by contacting us directly.

11.3 Change. You can also contact us to update or correct any inaccuracies in your personal information.

11.4 Delete. In certain situations, for example when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your data.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.

We may update this privacy statement to reflect changes to our information practices. SECTION 14. CONCENT

WE NEED CERTAIN PERSONAL INFORMATION IN ORDER TO PROVIDE YOU WITH ACCESS TO THE SITE. IF YOU CREATED A PROFILE OR IF YOU HAVE REGISTERED WITH US, YOU WILL HAVE BEEN ASKED TO TICK TO AGREE TO PROVIDE THIS INFORMATION IN ORDER TO ACCESS OUR SERVICES AND VIEW OUR CONTENT. THIS CONSENT PROVIDES US WITH THE LEGAL BASIS WE REQUIRE UNDER APPLICABLE LAW TO PROCESS YOUR DATA.
